Terms of Service

Effective Date: January 12, 2026

1. Acceptance of Terms

By engaging Always There Home Care Services, LLC ("ATHC," "we," "us," or "our") for home care services, you ("Client," "you," or "your") agree to be bound by these Terms of Service. Please read these terms carefully before using our services. If you do not agree to these terms, please do not engage our services.

2. Services Provided

ATHC provides non-medical home care services including, but not limited to:

  • Companionship and social engagement
  • Personal care assistance
  • Daily living activities support
  • Meal preparation assistance
  • Light housekeeping
  • Transportation assistance
  • Medication reminders (non-medical)

All services are provided in accordance with Pennsylvania state regulations and our license from the Pennsylvania Department of Health.

3. Service Agreement

Prior to beginning services, ATHC will conduct a comprehensive Needs Assessment with the client and, if desired, family members or representatives. Based on this assessment, we will:

  • Develop a personalized care plan
  • Establish a schedule of services
  • Define duties and responsibilities
  • Set service frequency and duration
  • Establish performance evaluation criteria

The care plan may be modified as client needs change, with mutual agreement between ATHC and the client.

4. Client Responsibilities

As a client, you agree to:

  • Provide accurate and complete information during the needs assessment
  • Maintain a safe working environment for caregivers
  • Inform ATHC promptly of any changes in health status or care needs
  • Treat caregivers with respect and dignity
  • Provide timely payment for services rendered
  • Give reasonable notice for service changes or cancellations
  • Allow access to the home during scheduled service times

5. Caregiver Standards

All ATHC caregivers are:

  • Properly credentialed and trained
  • Background checked and vetted
  • Bonded and insured
  • Committed to professional standards of care
  • Required to maintain client confidentiality

6. Fees and Payment

Service Rates: Fees are established during the initial consultation and documented in the service agreement.

Payment Terms: Payment is due as specified in your service agreement. Accepted payment methods include check, credit card, and direct bank transfer.

Late Payments: Late payments may result in suspension of services until the account is brought current.

Rate Changes: We reserve the right to adjust rates with 30 days' written notice.

7. Cancellation and Rescheduling

By Client: We request at least 24 hours' notice for cancellations or schedule changes. Cancellations with less than 24 hours' notice may be subject to a cancellation fee.

By ATHC: We will make every effort to provide consistent service. In the event we must cancel or reschedule, we will provide as much advance notice as possible and work to arrange alternative coverage.

Service Termination: Either party may terminate services with 14 days' written notice.

8. Limitation of Services

ATHC provides non-medical home care services. We do not:

  • Provide skilled nursing or medical services
  • Administer medications (we may provide reminders only)
  • Provide services requiring medical licensure
  • Make medical diagnoses or treatment decisions
  • Guarantee specific health outcomes

9. Liability and Insurance

ATHC maintains appropriate liability insurance and workers' compensation coverage for our employees. We are not liable for:

  • Pre-existing medical conditions or health deterioration
  • Loss or damage to client property due to normal wear and tear
  • Injuries sustained by clients during activities against caregiver advice
  • Events beyond our reasonable control

10. Confidentiality

ATHC maintains strict confidentiality of all client information in accordance with HIPAA regulations and our Privacy Policy. Please refer to our Privacy Policy for detailed information about how we protect your personal and health information.

11. Emergency Procedures

In the event of a medical emergency, caregivers are instructed to:

  • Call 911 immediately
  • Notify designated emergency contacts
  • Notify ATHC management
  • Provide emergency responders with relevant health information
  • Remain with the client until family or emergency personnel arrive

12. Quality Assurance

We are committed to providing excellent care. We regularly evaluate our services through:

  • Periodic client satisfaction surveys
  • Supervisor home visits and assessments
  • Ongoing caregiver training and education
  • Review of care plans and service delivery

13. Complaints and Grievances

If you have concerns about our services, please contact us immediately. We are committed to resolving issues promptly and professionally. You also have the right to file a complaint with the Pennsylvania Department of Health.

14. Governing Law

These Terms of Service are governed by the laws of the Commonwealth of Pennsylvania. Any disputes arising from these terms or our services shall be resolved in the courts of Pennsylvania.

15. Modifications to Terms

ATHC reserves the right to modify these Terms of Service at any time. Material changes will be communicated to active clients in writing. Continued use of our services after notification constitutes acceptance of the modified terms.
